A Guyanese national had his day in to court earlier this week (Monday, March 18) answering the charges in connection with Breach of the Immigration Act.
According to reports, Mark Henry, 45, appeared before Magistrate Charlton Smith in court #2 charged with Overstaying, Contrary to Section 28(1) & (3) and Punishable under Section 49(1) of the Immigration Act, Chapter 191, Statute Law of The Bahamas Revised Edition 2000.
Particulars revealed that on Friday (March 15), Henry was found in Freeport, Grand Bahama after the expiration of 14 days granted to him by an Immigration officer on November 5, 2017.
Henry claimed to have entered The Bahamas legally after the passing of Hurricane Matthew and remained in the country without extending his visitor’s status or seeking to regulate his status.
The Guyanese national, who was represented by Attorney Rufus Allen, pled guilty. He was convicted and ordered to pay a fine of $2,000.00 and given a default sentence of four months at the Bahamas Department of Correctional Services (BDCS) in New Providence.
Henry paid his fine and was handed over to officers of the Immigration Department, who will expedite his departure from the country to Guyana.
Meanwhile, on Tuesday, March 19 Immigration officers took two Ecuadorian nationals to court charging them with Overstaying.
Nancy Viviana Alvarez Jomenez, 21, and Luis Fernando Chuya Tinizhanay, 21, appearing Deputy Chief Magistrate Debbye Ferguson were charged with Overstaying Contrary to Section 28(1) & (3) punishable under Section 49(1) 0f the Immigration Act 191, Statute Law of The Bahamas, Revised Edition 2000.
According to court information, Jiminez and Tinizahanay were both found in Freeport, Grand Bahama after the expiration of the seven days granted them by an Immigration officer on February 21, 2019
The pair pled guilty, was convicted and ordered to pay $3,000 and given a default sentence of two years.
The Ecuadorians admitted to the court that they were making preparatory steps to be smuggled to the U.S.
Upon payment of their fines or serving their court imposed custodial sentences, the duo is expected to be deported to Ecuador.
